14th Amendment
Congress drafted the Fourteenth Amendment, which provided a Constitutional basis for the Civil Rights Act. The amendment states, “all persons born or naturalized in the United States” are citizens of the country. In essence, it granted African Americans citizenship and equal protection under the law.
Under this amendment, Congress specifically allows freed slaves to have citizenship and due process.
